The Delhi High Court on Thursday ordered the immediate removal of the nearly two-decade-old song Volume 1, associated with singer Honey Singh and Badshah, from all online platforms. The track, released around 2006–07 under their collaboration Mafia Mundeer, has come under judicial scrutiny, with the court directing all links hosting the song be taken down without delay, calling it “derogatory towards women.” What the court order said A bench of Justice Purushaindra Kumar Kaurav, hearing a petition filed by Hindu Shakti Dal, made strong observations on the nature of the song’s lyrics. “This is one of the rare cases where the conscience of the court is shocked to its absolute core," the court said while announcing the removal. "It is one of those unfortunate instances where the court finds that the song is grossly vulgar, patently obscene, and derogatory towards women, artistic values, and social norms. The lyrics are not merely disrespectful or offensive but are ex facie calculated to normalise the treatment of women as objects of ridicule and sexual gratification,” the justices observed. The bench further noted that such content cannot be protected under free speech if it is freely accessible online. “No civilised society can permit such content to remain freely available or be monetised… [Honey Singh] and [Badshah] and any other persons claiming rights in the impugned obscene song(s) are directed to immediately take down the URLs hosting such content from social media platforms or any other online locations,” the order…

Desai had raised questions about the procedure adopted by the commission for authenticating online material before using it to frame questions in examinations conducted by the public service recruitment body. But it did not get a clear response. “My order was very specific. I propose to issue contempt against your Secretary and Chairman both,” justice Desai said in an oral observation on April 2. The bench is hearing a case filed by a candidate who failed to clear the exam by one mark and challenged the correctness of the answer stipulated by the recruitment body for a question on the Arthashastra, Kautilya’s classical treatise on economics and politics. In previous proceedings, the high court had asked GPSC to produce the original book from which the question was framed, the 1915 English translation of the Arthashastra. When GPSC informed the court that the physical copy of the book was not available and that the commission had relied on an online version of the book downloaded from the internet. New Delhi: The Supreme Court has brought an end to a decade-long matrimonial dispute that spiralled into over 60 cases across the country, facilitating a comprehensive settlement between an estranged couple and granting them divorce, ending one of the most litigation-heavy marital disputes to have reached the top court. A bench of justices B V Nagarathna and Ujjal Bhuyan invoked Article 142 of the Constitution to give a “quietus” to the litigation between the couple, noting that the parties had voluntarily arrived at a settlement covering all disputes arising out of their marriage, which was solemnised in 1994. The case had reached the top court in the form of contempt proceedings, but over the course of hearings in January and February this year, the bench actively engaged with both sides to explore the possibility of a resolution. What followed was a structured, court-facilitated negotiation process that ultimately culminated in a joint application seeking dissolution of marriage on mutually agreed terms. Recording the presence of both parties in court, the bench underscored in its order released on Thursday that the settlement had been arrived at “on their own free volition without there being any coercion or undue influence”. The court then proceeded to examine the terms of the agreement and found “no legal impediment” in accepting them. The settlement provides for a permanent alimony of ₹1 crore to be paid by the husband to the wife, along with the transfer of his share in a Lonavala property through a registered gift deed.

Supreme Court judge recuses self from case after reserving verdict NEW DELHI: Supreme Court judge Justice K V Viswanathan has recused himself from a case after the hearing was wrapped up and judgment reserved, making it a rare instance of recusal at the stage of pronouncement of the verdict. One of the leading advocates in the country with a flourishing practice before he was elevated as an SC judge, Justice Viswanathan had appeared in innumerable cases for various clients in his 35 years of practice. While adjudicating a petition filed by Alchemist Asset Reconstruction Company Pvt Ltd (AARC), a bench of Justices J B Pardiwala and Viswanathan had reserved its verdict on March 17. However, Justice Viswanathan later came to know he had once appeared for AARC as an advocate. Justice Viswanathan immediately recused himself, and the bench recalled its order of March 17 and asked the CJI to reconstitute the bench for a fresh hearing in the case. “This matter was heard, and the judgment was reserved. After the judgment came to be reserved, it has come to the notice of Hon’ble K V Viswanathan... his lordship had appeared as a counsel for the appellant in the corporate insolvency resolution process... In such circumstances, the order dated March 17 is recalled,” the bench said.
