Bank loses Rs 87 lakh to SIM swap fraud, HC orders BSNL to pay over Rs 55 lakh compensation NEW DELHI: The Karnataka high court has ruled that BSNL is liable for losses caused by SIM swap fraud after one of its officials issued a duplicate SIM card without authorisation, enabling cybercriminals to drain over Rs 87 lakh from a cooperative bank's account through fraudulent online transfers. Justice Suraj Govindaraj, while deciding two writ petitions arising from the same fraud, dismissed BSNL's challenge to the compensation order and enhanced the award in favour of the Sri Basaveshwara Pattana Sahakara Bank Niyamitha. It directed the BSNL to pay Rs 50 lakh as principal compensation, Rs 5 lakh as consequential damages, and interest at 9 per cent per annum from February 7, 2019, the date of the last fraudulent transaction. How did the fraud unfoldedThe Co-operative Bank, maintained a current account with Canara Bank linked to internet banking. Its registered BSNL mobile number was used to receive One-Time Passwords (OTPs) for authenticating transactions. Between February 6 and 7, 2019, seven unauthorised RTGS/NEFT transactions totalling Rs 87.7 lakh were made from the bank's account. After the inquiry, it emerged that an unknown person had obtained a duplicate SIM linked to the bank's registered mobile number from a BSNL office in Bengaluru, without any request, consent, or knowledge of the Co-operative Bank. Using OTPs received on this duplicate SIM, the fraudsters completed the transactions.

SC: Can’t use OSA to deny accused access to documents relied on by prosecution NEW DELHI: Holding that it is part of an accused’s right to fair trial that he gets access to documents relied upon by the prosecution, Supreme Court has said invocation of the Official Secrets Act (OSA) cannot take away the right of the accused person to get copies of the documents forming part of the chargesheet even if they are highly classified and confidential pertaining to national security. A bench of Justices J K Maheshwari and Atul S Chandurkar directed the Centre to provide the alleged secret confidential documents to Major General V K Singh (Retd), who is facing prosecution under OSA. In a significant development in the Supreme Court’s ongoing crackdown on unauthorised constructions and land-use violations, the bench of Justice Ahsanuddin Amanullah and Justice R. Mahadevan has directed the Commissioner of the Greater Bengaluru Authority to submit a personal explanation after the Court noted, on the basis of an office report, that notice sent to the authority had allegedly been refused. "We take note of the Office Report dated 19.05.2026 indicating that service is complete upon all respondents except the authority at Bengaluru, where notice was reportedly refused," the bench noted. The State of Tamil Nadu & Ors. escalated what began as a Tamil Nadu residential zoning dispute into a full-scale, nationwide audit of building law violations. The case traces its origins to an unauthorized G+1 structure built without a sanctioned plan in Chennai. The Supreme Court, after dismissing the petitioner's SLP on February 16, 2026, had directed the Greater Chennai Corporation to explain how such violations went unchecked.

Arbitration now resembles disease it was meant to cure: CJI Surya Kant Chief Justice of India Surya Kant on Friday criticised the increasing complexity, cost and exclusivity of modern international arbitration, saying that a process created as an alternative to litigation was beginning to acquire the same defects it was meant to avoid. He said "Arbitration was built to be the answer to the pathologies of formal litigation, and it is seemingly acquiring each of those very failings. In other words, the remedy has come to resemble the disease it was designed to kill." The CJI was speaking at the 4th International Conference of the Indian Council of Arbitration (ICA) on arbitrating Indo-UK commercial disputes in London. The conference, held during London International Disputes Week 2026 at Church House, focused on ADR as a catalyst for strengthening the Indo-UK economic partnership. The event was also attended by Master of the Rolls and Head of Civil Justice of England and Wales Sir Geoffrey Vos, Deputy High Commissioner of India to the United Kingdom Karthik Pandey, Vice President of the Law Society of England and Wales Brett Dixon, ICA President Dr NG Khaitan and ICA Director General Arun Chawla. Justice Surya Kant said arbitration must ask with candour where it may have drifted from its founding purpose and what must be done to restore that purpose. He said arbitration did not begin as a creature of statute and did not spring into life with the English Arbitration Act of 1889, India’s first arbitration legislation of 1899 or the New York Convention of 1958. Those instruments, he said, merely recognised, regularised and regulated a practice that commerce had already developed over centuries.
